Participation in dkeniz by Erik Juwelier competitions is governed exclusively by these terms and conditions.

 

By participating in the competition, the participant declares their agreement to these terms and conditions and the privacy policy. The competition is not affiliated with Instagram and is not sponsored, supported, or organized by Instagram in any way. The organizer and the participant release Instagram from all claims in connection with this competition.

 

Since the competition takes place on Instagram, the general terms and conditions of Facebook Ireland Limited Hanover Reach, 5-7 Hanover Quay, Dublin 2 Ireland, which can be found at: www.facebook.com/terms.php?ref=pf

 

In addition to these terms and conditions of participation, the relationship between the organizer, the participant and Instagram is governed by the terms and conditions of participation (www.facebook.com/terms.php) and META's privacy policy (www.facebook.com/policy.php) certainly.

 

All inquiries and information regarding the competition should be addressed to the organizer and not to Facebook or Instagram.

 

 

 

2. Promotion period & participation

 

Instagram platform:

The Advent competition begins on Thursday, December 1, 2022, at 7:00 a.m. and ends on Saturday, December 24, 2022, at 11:59 p.m.

The exact period of each individual competition extends from the time the post is made until the time stated in the competition post (“Promotion Period”).

Participation in the competition takes place under the competition posts published by the organizer on Instagram.

 

Participation in the competition is subject to the following conditions of participation:

 

1. Liking the competition post on the respective platform (Instagram)
2. Subscribe to “Follow” the fan page of “dkeniz” on Instagram “dkeniz_official”
3. Specify your favorite emoji in the comment field

 

Only participants who have met all of the above-mentioned conditions of participation will be considered for the prize draw. Likes, subscribers, and comments received after the closing date will not be considered in determining the winner of the respective competition.

“dkeniz” reserves the right to update the conditions of participation at any time and to request participants to reconfirm the conditions of participation. 

 

During the promotional period, anyone living in the following countries

as well as anyone who

• has reached the age of 18

Participate in the "Advent Calendar" competition. For minors, consent from a parent or guardian is assumed.

 

Employees of the organizer, as well as employees of cooperation partners who are or were involved in the creation or implementation of the competition, as well as their family members, are excluded from participation in the competition.

 

Participation in the competition is free of charge. However, participation may involve costs due to the need for an internet connection. The amount of these costs depends on your internet plan. These costs cannot be influenced by the organizer.

 

3. Profit

 

By participating, there is a chance to win the items mentioned in the competition post. Each item is a piece of jewelry from dkeniz. The winner is only entitled to this one prize. Cash payment, exchange, or transfer of the prize to another person is not possible. The winner is responsible for any taxation of the prize. The prize will be delivered via email by January 13, 2023, at the latest.

 

4. Drawing and announcement of the winner

 

The winner will be determined at the time specified in the competition. The winner will be randomly selected from all participants who have fully met all the conditions of participation.

 

The prize will be raffled off among the participants under the respective competition post on the respective platform (Instagram). This means that the winner of the competition will be notified of their win via direct message on the respective platform (Instagram) with the winner's platform username.

Upon announcement, the winner will be asked to confirm acceptance of the prize, including their full name and email address, in a private message to the organizer's Instagram profile. The organizer reserves the right to request proof of identity to verify the winner's age. Receipt of the message will be confirmed by the organizer. If the winner does not respond by January 13, 2023, their right to the prize will be forfeited. Participation in the competition is free of charge. Legal recourse is excluded. 

 

 

5. Disclaimer of Warranties

 

5.1. No guarantee of availability of the website

 

The organizer points out that availability on https://www.instagram.com/dkeniz_official/ cannot be guaranteed 100%. The app/website may be unavailable due to external circumstances and/or technical problems, without giving rise to any claims by participants against the organizer.

 

5.2. Content provided by participants, exclusion

 

1. a) No illegal, abusive, defamatory, unauthorized, malicious, violating personal rights, glorifying violence, or racist content may be published in connection with this contest. No commercial or political advertising may be published. This prohibition applies to political content that is incompatible with the values of the Basic Law of the Federal Republic of Germany. No information or content harmful to minors may be disseminated. Furthermore, racist, violent, politically extremist, sexist, discriminatory, or otherwise offensive publications, as well as those that insult, defame, threaten, or verbally disparage other individuals, ethnic groups, or religious denominations, are permitted. Participants agree not to infringe any copyright, patent, trademark, or other intellectual property rights of third parties.

 

1. b) The participant indemnifies the organizer against all claims asserted by third parties against the organizer due to a violation of their rights by content posted by the participant as part of the contest or through other use of the content. In the event of a claim by third parties, the participant is obligated to promptly, truthfully, and completely provide the organizer with all information available to them that is necessary for an investigation of the claims and a defense. Any further claims for damages by the organizer against the participant remain unaffected.

 

1. c) The organizer also expressly reserves the right to modify the contest with regard to its design or specific conditions in the event of previously stated behavior or other disruptions. The organizer is also entitled to exclude participants from this contest who violate the terms and conditions, provide false personal information, use unfair means, and/or attempt to use images or name ideas for the contest that they are not the author of and/or violate the rights of third parties, such as their rights of use or personal rights.

 

5.3 Early termination

 

The organizer reserves the right to terminate the contest before the end of the promotional period without prior notice and without stating reasons. This applies in particular to any reasons that would disrupt or prevent the contest from running as planned.

 

6. Limitation of Liability

 

The organizer is liable in accordance with statutory provisions for intent and gross negligence on the part of the organizer, its legal representatives, or vicarious agents, as well as for culpable breaches of essential contractual obligations. In the case of only slightly negligent breaches of essential contractual obligations, liability is limited to compensation for damages typical for the contract and foreseeable at the time of use of the game. This limitation of liability does not apply to damages resulting from injury to life, body, or health caused culpably by the organizer, its legal representatives, or vicarious agents, nor to liability under the Product Liability Act.

 

The above limitation of liability applies in particular to damages caused by errors, delays or interruptions in the transmission of data or similar, malfunctions of technical systems or services, incorrect content, loss or deletion of data, viruses.

 

The organizer is not liable for damages resulting from the impairment of the availability of the Instagram account due to technical malfunctions beyond its control. Likewise, no liability is assumed for force majeure. The organizer does not guarantee that the Instagram account will function properly on the respective participant's mobile phone/computer.

 

There are no guarantee or warranty claims against the organizer regarding the prize.

 

 

7. privacy

 

7.1. Personal data

 

Personal data is information about the personal and factual circumstances of an identified or identifiable natural person, i.e., information that identifies a person or at least makes that person identifiable. All of this data is subject to special protection in accordance with data protection regulations, which the organizer ensures through technical and organizational measures.

 

 

 

 

 

7.2. Collection, processing and use of personal data

 

In order to process the prize draw, the winners must provide the data specified in section 2.5. This data will be used to check eligibility, determine the winner, notify and distribute the prize, and if necessary to publish the winner's details. The legal basis for this is Art. 6 (1) (b) GDPR. The data will be deleted after 30 days. If deletion is not possible due to statutory retention periods, the participant's data record will be blocked until the end of the retention period, i.e. the data will be excluded from further use. For the purpose of processing the prize draw, the winner's first name, last name, and email address will be passed on to dkeniz by Erik Juwelier, Am Plärrer 27, 90429 Nuremberg, Germany. Personal data will not be passed on or sold to third parties not involved in the competition. Personal data will only be transferred to government institutions and authorities if required by law. The participant hereby expressly consents to the storage and use of the personal data provided by the aforementioned institutions for the aforementioned purposes.

 

7.3 Rights of participants and winners

 

The winner and the participants have the right to request, free of charge, what data has been stored about them as part of the contest. Each participant has the right to request the immediate deletion of their personal data at any time. The participant confirms that the personal information they have provided, in particular their first name, last name, and email address, is true and correct.

 

7.4. Revocation

 

The participant may revoke any additional consents given at any time. The revocation must be sent in writing to the organizer's contact details provided in these terms and conditions. 8. Final Provisions

 

8.1 Questions or complaints

 

Questions or complaints regarding the contest should be directed to the organizer.

 

8.2. Exclusion of UN Sales Law

 

The organizer’s contest is subject exclusively to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

 

 

8.3 Validity of the Conditions of Participation

 

Should any of these Terms and Conditions of Participation be or become invalid or ineffective, the validity and effectiveness of the remaining Terms and Conditions of Participation shall remain unaffected. The invalid or ineffective provision shall be replaced by the legally permissible provision that most closely approximates the economic meaning and purpose expressed in the invalid provision. The same applies if there is a gap in these Terms and Conditions of Participation.
